Welcome to PaperBall.Academy ("the Site"), an educational platform created and managed by The Kutuhala Trust, Bangalore. By accessing or using our website, mobile applications, or services, whether as an individual learner (B2C) or an institutional partner such as a school (B2B), you agree to comply with and be bound by the following Terms and Conditions.

1. Definitions

• "We", "Us", "Our" refers to The Kutuhala Trust, Bangalore.
• "You", "User" refers to individual learners, parents, teachers, or schools accessing the Site.
• "Institutional Users" means schools or organizations using the Site under a group license or custom integration.

2. Scope of Services

PaperBall.Academy offers:

• Interactive educational content and assessments.
• Teacher resources and dashboards for institutions.
• Personalized learning experiences for individual users.
• Licensing options for schools for multiple student access.

All users must use the platform strictly for educational purposes only.

3. License and Access

Subject to compliance with these Terms:

• Individual Users are granted a limited, non-exclusive, non-transferable license to use the platform for personal learning.
• Institutional Users may access the platform for use by registered students under a subscription or partnership agreement. Institutions must not relicense, sub-license, or commercially exploit the content.

4. Account Registration and Responsibilities

• Users must register with accurate details and safeguard login credentials.
• Institutions must ensure access is limited to authorized users.
• Account sharing is prohibited unless otherwise agreed in writing.

5. Intellectual Property

All content is the sole intellectual property of The Kutuhala Trust or its partners. No content may be copied, distributed, or used commercially without consent.

6. Payments and Subscriptions

Fees must be paid in full before activation. Institutional pricing is based on specific agreements.

Refund Policy:

• B2C: No refunds unless there’s a clear and verifiable product fault. Must be reported within 7 days.
• B2B: Payments are non-refundable unless stated in the agreement. Prorated refunds may be considered only in case of material breach by the Trust.

7. Termination and Suspension

We may suspend or terminate accounts for breaches, unauthorized use, or non-payment. No refund will be issued in such cases.

8. Use Restrictions

• No illegal or unauthorized use of the Site.
• No scraping, data copying, or bot activity.
• No uploading of offensive or infringing content.

9. User-Generated Content

By uploading content, users confirm they have rights and grant us a license to use it for educational purposes.

10. Disclaimer of Warranties and Limitation of Liability

The platform is provided "as is". We make no guarantees regarding accuracy, uptime, or security. Liability is limited to the fullest extent permitted by law.

11. Certificates

Certificates may be offered at our discretion but do not carry official academic recognition unless explicitly stated.

12. Institutional Licensing Terms

• Institutions must limit use to enrolled students/teachers.
• Redistribution of credentials or content is prohibited.

13. Privacy and Data Use

Data is used only for improving learning, support, and consent-based promotion. Security measures are implemented but absolute security is not guaranteed. See our Privacy Policy.

14. Age Restrictions and Parental Consent

B2C: Users under 13 must have parental consent.
B2B: Institutions are responsible for obtaining parental consents for student users.

15. Modifications to Terms

These Terms may be updated periodically. Continued use indicates acceptance.

16. Jurisdiction

Governing law is Indian law. Disputes are subject to courts in Bangalore, Karnataka.
